What is a defective product? It is a product that causes damage or injury to a person as a result of an inherent deficiency in the product, the way it is marketed or used. If such a defective product causes injuries or death, the product manufacturer may be held liable. All states have some form of product liability law.

There are three basic types of defects:

  • Manufacturing defect: This means that there was no problem with product design, but that something went wrong with the manufacturing process that made the product defective or dangerous
  • Design defect: This means the way the product was designed was in itself dangerous or unsafe for users. For example, an improperly designed seatbelt may fail to protect a person wearing it even in a low-impact crash
  • Lack of proper instructions or warnings: The product may be perfectly safe, but the manufacturer fails to include proper instructions about assembly and/or use.
